Terms and Conditions of Sale

Article 2 — Purpose and scope
These Terms and Conditions of Sale ("T&C") govern all sales concluded by the seller with its customers, whether consumers or professionals, via the Site.
The seller offers personalised items and handcrafted products: t-shirts, sweatshirts and hoodies, mugs, keyrings and accessories, engraved wood and slate objects, as well as DTF transfer film sold by the metre.
Any order placed on the Site implies full acceptance of these T&C. The seller may amend the T&C at any time; the applicable terms are those in force on the order date.
Article 3 — Products and personalisation
The essential characteristics of the products are described on the product pages. Photographs are as accurate as possible but cannot bind the seller to an exact reproduction of colours, which may vary depending on the screen, the material and the printing or engraving processes.
As products are mostly personalised at the customer's request (design, text, photo, engraving…), the customer is solely responsible for the content they provide or order. They warrant that they hold all necessary rights to the visuals, logos, texts, images and trademarks supplied, and that these infringe no third-party rights or public order. The seller may refuse any order whose content is unlawful, infringing, defamatory, hateful, violent or contrary to public decency.
Article 4 — Prices
Prices are shown in euros, net of tax, excluding delivery costs. Delivery costs are stated before the order is finally confirmed.
The seller may change prices at any time; products are invoiced at the price in force when the order is confirmed. Quantity discounts may apply, in particular for DTF transfer film sold by the metre (degressive pricing), under the conditions shown on the Site.
Article 5 — Orders
The customer selects the desired products and options, provides their personalisation details, then confirms the basket. The order is final once payment is validated. A confirmation email is sent to the customer.
The seller may cancel or refuse any order from a customer with whom a dispute over payment of a previous order exists, or whose personalisation content is refused under Article 3. Records kept by the seller constitute proof of all transactions. The contract is concluded in French.
Article 6 — Payment
Payment is made online at the time of order, by credit/debit card and PayPal (with instalment options under PayPal's conditions). Transactions are secured by our payment providers. The seller has no access to the customer's banking data, which is processed directly by the payment provider.
The order is only put into production once payment is actually received. In the event of failed or refused payment, the order is automatically cancelled.
Article 7 — Production and delivery
As products are personalised, they are made after the order is received. The indicative production time is up to 5 business days, plus the shipping time.
Products are delivered to the address given by the customer via Mondial Relay (pickup point delivery). Costs and times are stated at the order stage.
In accordance with article L216-1 of the French Consumer Code, the seller undertakes to deliver within the announced time and, failing that, no later than 30 days after conclusion of the contract. In the event of delay, the consumer may request cancellation and refund under articles L216-2 et seq.
The risk of loss or damage passes to the customer when they (or a third party they designate) take physical possession of the products. The customer should check the parcel on delivery and report any anomaly (opened, damaged, non-compliant) to the carrier and the seller as soon as possible.
Article 8 — Right of withdrawal
For any non-personalised, standard products sold as-is, the consumer has 14 days from receipt to exercise their right of withdrawal, without justification, under articles L221-18 et seq. To do so, the customer notifies their decision by an unambiguous statement (email to contact@judesign3d.fr or post) before the deadline. Products must be returned new, complete and in their original packaging; return costs are borne by the customer. The refund is made within 14 days of recovering the products or proof of their dispatch.
Article 9 — Legal guarantees
Regardless of any commercial warranty, the seller remains liable for lack of conformity and hidden defects under the law.
- Legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code): the consumer has 2 years from delivery to act and may choose between repair or replacement, subject to legal cost conditions, with a 24-month presumption of pre-existing defect.
- Guarantee against hidden defects (articles 1641 et seq. of the French Civil Code): the customer may obtain cancellation of the sale or a price reduction under the law.
To invoke a guarantee, the customer contacts the seller at contact@judesign3d.fr describing the problem with photographs. These guarantees do not cover normal wear, misuse or care not following the recommendations (e.g. washing printed textiles at high temperature).
Article 10 — Personal data (GDPR)
Personal data collected (name, address, email, order data) is necessary to process and track orders, handled in accordance with Regulation (EU) 2016/679 (GDPR). The data controller is the seller identified in Article 1. The customer has rights of access, rectification, erasure, restriction, objection and portability, exercised at contact@judesign3d.fr, and may complain to the CNIL (www.cnil.fr). Article 11 — Intellectual property
All elements of the Site (texts, visuals, logo, graphic identity, the seller's own creations) are protected by intellectual property law and remain the seller's exclusive property. Any unauthorised reproduction is prohibited. Visuals and creations supplied by the customer remain their property and/or that of the respective rights holders, the customer guaranteeing their lawfulness under Article 3.
Article 12 — Liability and force majeure
The seller cannot be held liable for non-performance in the event of force majeure, disruption or strike of postal and transport services, or any event beyond its reasonable control. The seller's liability shall in any case not exceed the amount of the relevant order.
Article 13 — Complaints and consumer mediation
In the event of a dispute, the consumer should first contact the seller at contact@judesign3d.fr to seek an amicable solution.
Under articles L612-1 et seq. of the French Consumer Code, where a written complaint to the seller has not resolved the dispute, the consumer may use a consumer mediator free of charge. The competent mediator for the seller is:

The consumer may refer the matter to the mediator within one year of their written complaint to the seller.
Article 14 — Governing law and jurisdiction
These T&C are governed by French law. Failing an amicable solution, and unless a mandatory legal provision protecting the consumer provides otherwise, any dispute falls under the jurisdiction of the French courts.
